General Terms and Conditions of Trade

Introduction
These General Terms and Conditions of Trade ("Terms") govern the relationship between CHIKOPOKOPO HELICOPTERS TOURS ("CHIKOPOKOPO") and any Reseller or Customer engaging CHIKOPOKOPO's services. Unless superseded by “activity-specific conditions” outlined herein or in separate agreements, the following provisions shall apply.

1. Prices
1.1. All prices are quoted in United States Dollars (USD).
1.2. All prices include Value Added Tax (VAT) and the Zimbabwean Government Tourism Levy where applicable.
1.3. All prices exclude National Park fees for activities where applicable.
1.4. National Parks usage and entry fees are subject to change. Resellers should verify current fees at the time of booking to provide accurate information to clients.
1.5. CHIKOPOKOPO reserves the right to amend prices without prior notice due to market conditions or other factors.

2. Payment
2.1. All payments shall be made in USD unless a special arrangement is made between the parties and confirmed in writing.
2.2. Full payment is required before the date of travel unless prior arrangements have been made.
2.3. Credit terms may be extended to the Reseller by separate agreement and at the discretion of CHIKOPOKOPO.

3. Taxes and Withholding
3.1. Prices will include VAT at the current standard rate where applicable.
3.2. Zimbabwean Resellers must provide their VAT Registration Number and Tax Clearance Certificate.
3.3. In accordance with tax regulations, CHIKOPOKOPO may deduct withholding tax from payments to Resellers. These withheld funds will be remitted to the Zimbabwe Revenue Authority (ZIMRA).

4. Bookings
4.1. All bookings shall be made with the CHIKOPOKOPO Central Reservations Office ("CRO") in Victoria Falls.
4.2. Confirm availability with CHIKOPOKOPO CRO prior to booking.
4.3. All clients must be in possession of a valid CHIKOPOKOPO travel voucher (hard copy or digital) and present it prior to embarking on any CHIKOPOKOPO activity.

5. Children, Young Adult and Age Restrictions Policy
5.1. Children may be entitled to discounts on certain CHIKOPOKOPO activities. Please refer to the Children's Discount Policy Table in Appendix B.
5.2. Age restrictions apply to specific activities. Please refer to the Activity-Specific Terms and Conditions in Appendix A.
5.3. Some activities have additional restrictions for children and young adults, such as weight or participation limitations. Please refer to the Activity-Specific Terms and Conditions in Appendix A.

6.0 General Cancellation Policy
6.1. In the event that the Reseller cancels their reservation for any reason, such cancellation must be made in writing (or if made telephonically, confirmed forthwith in writing). The Reseller shall be liable for CHIKOPOKOPO's cancellation charges as set out in the cancellation policy.
6.2. Amendments and all cancellations en-route must be made by the Reseller. The Reseller shall be liable for all costs, including but not limited to repatriation and administrative fees incurred by CHIKOPOKOPO as a result of any en-route cancellations by the Reseller, including cancellations due to ill health or injury.
6.3. Cancellation shall be effective only on the date which CHIKOPOKOPO receives the notification of cancellation.
6.4. Cancellations made within 24 hours of the scheduled activity, or failure to arrive (no-show), will result in a cancellation fee equal to 100% of the total price.

7.0 Cancellation of Service
7.1. All activities are subject to availability and may be affected by weather conditions, river levels, or other factors beyond CHIKOPOKOPO's control.
7.2. CHIKOPOKOPO reserves the right, at its sole discretion, to refuse to allow any of the Reseller's Resellers (whether an adult or child) to take part in any or all of CHIKOPOKOPO's tourist activities.
7.3. CHIKOPOKOPO reserves the right to cancel any activity due to unfavourable conditions, including but not limited to weather or safety concerns.

8.0 Travel Documents, Insurance, Vaccinations, Inoculations, and Re-entry Permits
8.1. All Resellers shall ensure that the traveller(s) are in possession of and have complied with:
(a) The correct travel documentation, including passports valid for the minimum period required by law in each country the
traveller will visit.
(b) The correct visas and re-entry permits, valid for the countries visited. Visa costs incurred are for the traveller’s own account.
(c) Health, foreign exchange, and other legal requirements.
8.2. The Reseller shall advise the traveller to take out comprehensive travel insurance and to familiarise themselves with any exceptions and conditions imposed by the insurance provider, CHIKOPOKOPO, or underwriters issuing the policy of insurance selected. CHIKOPOKOPO shall not be responsible or liable for any matters arising from the Reseller's failure to comply with this clause.

9.0 Resellers' Responsibility and Liability
9.1. The Reseller will inform their clients of all relevant information pertaining to activity requirements, including age and fitness restrictions, and shall be responsible for the collection of all money due from such clients and for payment to CHIKOPOKOPO.
9.2. The Reseller will inform their clients of any National Parks Fees or other additional charges that are payable and collected by CHIKOPOKOPO.

10.0 Variation of Terms and Conditions
10.1. No variation of these Terms and Conditions shall be binding unless communicated in writing by CHIKOPOKOPO.

11. Breach
11.1. Should any of these Terms and Conditions not be fully complied with, CHIKOPOKOPO reserves the right to:
(a) Cancel booking(s).
(b) Withdraw prices.
(c) Withdraw any other special trading arrangements.
(d) Take legal action as necessary.

12.0 Termination
12.1. CHIKOPOKOPO reserves the right to terminate this agreement by giving the Reseller one (1) months’ notice.

13.0 Legality
13.1. This Agreement is non-assignable and shall be construed and have effect in accordance with the laws of Zimbabwe.

14.0 Activity-Specific Terms and Conditions
14.1. Specific terms, conditions, age restrictions, and other limitations apply to individual activities offered by CHIKOPOKOPO. These activity-specific terms supersede the General Terms and Conditions where applicable. Please refer to Appendix A for detailed information.

Appendix A: Activity-Specific Terms and Conditions

1. Helicopter Scenic Flights
• Age Restrictions: Open to all ages.
• Children's Discount: Children below two (2) years of age fly for free but do not get a seat.
• Inclusions: Transfers to and from Victoria Falls accommodation.
• Conditions: Flights are subject to weather conditions and may be cancelled if unfavourable conditions prevail.
• Regulations: Governed by Civil Aviation Authority of Zimbabwe (CAAZ) regulations.
• Additional Fees: Clients are required to pay Government fees and Fuel Surcharge on/before check-in.
• Turnaround Time: 1 hour.

2. Sunset Cruise
• Age Restrictions: Open to all ages.
• Children's Discount:
o Children under two (2) years of age cruise for free but will not be allocated a seat or provided with snacks. However, for an
additional fee, snacks will be provided.
o Children aged 3-11 years pay half price.
• Inclusions: Return transfers from Victoria Falls accommodation, snacks, and beverages.
• Minimum Participants: 2 pax
• Additional Fees: Clients are required to pay National Parks River Usage fees at the SWA CRO.
• Turnaround Time: 2 hours 30 mins.

3. Game Drive(AM and PM)
• Minimum Age: 4 years.
• Children's Discount: Children aged 4-11 years pay half price.
• Inclusions: Return transfers, teas, coffees and muffins on morning trips, drink and light snacks for the afternoon trips.
• Additional Fees: Clients are required to pay National Parks fees on/before check-in
• Turnaround Time: 3 hours.

4. Chobe Day Trip
• Minimum Age: 4 years.
• Children's Discount: Children under 12 years pay 75% of the adult price.
• Inclusions: Return transfers, lunch.
• Passport Requirement: Clients must bring their passports. Visa fees apply where applicable.
• Turnaround Time: Full day.

Acknowledgment:
By making a booking with CHIKOPOKOPO, Resellers and Customers hereby acknowledge that they have read, fully understand, and agree to be legally bound by these General Terms and Conditions of Trade, including any activity-specific terms outlined in Appendix A.
